Better to start new labor process if your are nearing 6th year on H1. these audits take forever and mostly have -ve results. and the employers/attorneys are not helpful either.

I don't understand this, we are talking about these backlogs, which are effecting about 300K - 500K skilled immigrants, and we only have about 4000 members yet. We should take this as challenge and go on to drive to speak to people like us to increase the members strength, so we will have significant backing and Senate / House / President will pay attention to what we request.

I work for a TARP employer and my H1 extension is due on April 30th. I was able to get all the required approvals for the extension last month but immigration firm is not able to file H1 petition as drafted.
They are saying that my orignal H1 was for one legal entity (CORP) and I was working/getting paid by another(BANK NA) (I verified this from orignal H1 petition and W2s). HR and immigration firm are silent on how/why this happened. Now the issue if they do my extension under BANK NA TARP rules will be applied as entities are changing. They are not comfortable doing it for CORP becuase I am not working for it. Just spoke with HR and they are saying that they are looking at the options and what to do next. Not a definate answer will they file and if so under which legal entity?
Can any of the gurus please suggest me what do to? Should I start looking for another job with a consulting company and will even a H1 transfer be possible due to this mess. I am just soo tensed, we are expecting a baby anytime next week and hate this mess.

I also need to get my h1 stamped.
Has anyone stamped from Peru or some South American country?
Can you let me know if any issues.
The embassy has a number that gives access to a service where I can schedule an appointment .. but does not allow me to speak to anyone.
My understanding is that you can apply for H1B stamping only in Canada, Mexico, your country of residence or your home country. If your home country is not Peru or your country of residence is not Peru, you cannot apply for H1B stamping in Peru. I tried to do something similar and wanted to get my H1B stamped in Germany - but my lawyer told me that I could not do that.

Yes he can travel during the transfer, in order to file the transfer he will have to show latest paystubs from his previous H-1 employer or he has to show that he reported to work and was hired before he can file for a transfer. To file a transfer the USCIS charges $500 +$320+ $750 ($1500 if the petitioner has more than 25 employees).

My I-140 is approved and I485 was filed in July 2007 (pending more than 180 days)
I have an EAD.
My employer revokes the I-140 for people they lay off. Does the RFE come immediately when they revoke the I-140 or does it come at the time of adjudication - which in my case is a long time away since my PD is Feb 2007 in EB3 category.

Hi,
I had a question about the H-1B cap. I am currently in F-1 status in
graduate school and am planning to finish my degree requirements
sometime in March/April 2007 and eventually need to be in H-1B status
to continue to work in the US.
I previously was in the H-1B status from Jan. 2001 till Sep. 2001 (9 months)
for which I was counted towards the FY2001 H-1B cap (more than 6 years ago).
In Sep. 2001, I switched to F-1 status to get a PhD and haven't been
outside the US for more than 4 weeks since then. My question is
will I be subject to the H-1B cap again, and get a new 6-year H-1B
term, if a for-profit employer files an H-1B petition for me for FY2008
?
OR
will I get the remaining 5 years and 3 months from my previous H-1B and
not be counted against the H-1B cap ?
OR
will I get the remaining 5 years and 3 months from my previous H-1B and

I actually went for stamping in my 4th year, that's after extending my H1 after the first 3 years. They didn't ask any questions. I'm not from India though so I don't know whether its different.

You will say 'YES' for yourself and 'NO' for your dependents. Immigration petition is nothing but I-140, if any of your family members have filed I-140 then answer would be 'YES'

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

If you create a new 'plane' and position it below the object as a floor, you will get a shadow. You can move the light sources about to get the right shadow.

I had applied for my H1B extn and got an RFE. Lawyers replied to it and its almost 7 weeks now, haven't got any reply.
Is this a usual timeframe? how long will it usually take for USCIS to take any action on the RFE's after the reply was sent with all appropriate documents?

The image quality at high ISO numbers is also a big concern to me as well. I have found it mentioned but not much other than that. I shoot a lot of low light level photos. While I love Olympus, I also have to be aware that Olympus will be introducing at least tw new dSLR's this year that could well eclipse the E-Volt and at the least force the E-Volt prices lower.
