The New York Times reports on an uptick in legal actions against less than honest attorneys who bilk clients needing immigration services. In my two decades in practice, I've come across a number of these cases. But they usually increase in number as people grow more desperate. I was entered into the United States when I was 8 years old. I was entered on the plane with a fake passport and ever since I've been using my real name. I used my real name for school and college. I'm currently here illegally. I want to start my process of application for citizenship but there is a problem. My lawyer told me to marry under the name i entered with and so i did. Before we started the application he realized i was finger printed under my real name so if i were to apply my finger prints would show already in the system. So the only solution is to change my fake name to my real name (which doesnt have a visa) on the marriage license. How do i go about doing so? and will i still be able to obtain a green card? I reside in massachusetts.

I am planning to joing new empoyer on EAD even though I have proper H1B. Because employer do not want to sponser for anything. My wife is planning to go to india during this period and she will be using H4 for travel. My questions are
1. Can I swith to new job even though my wife is not here and she is going to use H4 visa which she got it as aresult of my h1b visa from my privious employer.
2. What are the thing we need to do or check before joining the new employer.
Any help in this regard is highly appriciated.

I work for a big company. Each time when I move to a new project, my company ask me to file an LCA and H-1B amendment for new project location. It takes several month to get approval until then you have wait and face all travel restrictions.
I know that several smaller companies don�t file such amendments
Does anyone who why do we have to file such amendment?

Dear IV members
This is for my wife. Her 485 is pending with TSC. PD is EB2 India March 15 2004. Has been current since September 1. After the USCIS website update recently received Document production or Oath Ceremony status update online. And message saying a document has been sent etc.
Since she was current we thought it might be good. 30 days later nothing received. Raised SR since we didnt receive anything. The customer service rep as usual didnt know anything. Said they haldn't received anything back. They opened SR. We got response 3 weeks later.
In the response letter it says that another notice will be forthcoming to tell you to go to local ASC.
Havent received anything. Do you think right now should I again pursue after them by writing to Ombudsman etc especially since case is current? Mainly I am afraid that since the status says Document production would some IO think that the case is already approved and so stop working on that case? Please advice. Thanks in advance.

My wife is on H4 visa and has started her MS in CS in Jan. She applied for her change of status to F1 visa on 15 th feb. As of today (17th March), her approval notice hasnt come and her H4 is expiring on 31st March. I am not even able to follow her case online on USCIS coz her return recipt number is not updated at all. This is quite common I have heard.
My question is, should we also apply for her H4 extension before 31st of this month so that in case her approval for F1 does not come before her H4 expires and in worst case it gets rejects, she still wont be out of status coz her H4 renewal application is in place or am i just being too paranoid and should just wait for her F1 to come??

I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.
In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.
Now, is there any way that anyone can Help me?

No worries. As you 140 was approved uscis gave 3year extension. It is not a mistake
