Hi Gurus,
I wanted to know if I can work for H-1B with my current company which holds my H-1B and work outside with another company on EAD. Is there a chance that I may loose my H-1B status if I work with EAD.

When you start using EAD you will lose H1 status. You can do multiple jobs on ead but not on H1

I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

Would appreciate the input on my querries by the attorneys & the people who has experienced similar situation.
My spouse's Advance Parole is expiring in mid February 2010. He is pplanning to travel to India by mid - jan & return back by 3rd feb'2010.
My questions is:
1) Is the time gap of 15 days before the expiry of the AP is safe to re-enter USA?
2) SHould he apply for the renewal of the AP before he leaves? If yes, then if the advance parole renewal approves before he re-enters the country, can he still re-enter on the old Advance Parole document or the old one gets automatically nullified?
3) Should he be in the country during the time the advance parole approves?
The situation is very urgent. Immediate feedback is highly appreciated.

If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.

I am on my 6th year of H1B. My current H1 expires mid August 2009.
My PERM was filed in May 2008 and was approved in Dec 2008.
My I-140 is applied and pending. I work for an american consulting company.
Naturally, I dont have an EAD as yet.
Based on my PERM approval and 365 day rule, I know I can extend my current H1 for 1 year.
(planning to do this ASAP).
Here is my question:
- My current client contract will get terminated soon. If my current GC sponsoring company decides to terminate my employment (due to project non-availability), can i transfer my extended H1B to another employer?
In other words, is an extension H1 (7th year and beyond) similar to regular H1 (first 6 years) in regards to invoke the "transfer" rule between eligible employers? or is it tied to GC sponsoring employer?
- By doing so, do I abandon my GC application (i think i will, but general clarification) ?
Any advise would be greatly appreciated,

Hi,
Once our 140 is approved in the sixth year of H1B, I learnt that we can seek a 3 yr extension. If that's the case, can we change companies during that 3 yr period or are we stuck with the same company that sponsored the 3 yr extension?

Hi All,
I'm looking for solutions in my situation.
I'm currently under a L1 visa for a company A but I would like to resign and look for another Job.
The thing is, as far as I understood, If I resign I have to leave the US. So here are my questions:
1) How long can I stay in the US after I resigned from my company under a L1 visa? Can I stay in the US even if my I-94 is valid?
2) How is the USCIS notified that I resigned from my company? Should I send a notification or is that done by my company?
3) Can I apply to a H1B COS by myself to then look for a job? Or will I need a company B to sponsor me?
4) If I can't apply to a H1B COS by myself, do I have any other visa options?

Hi All,
I am a bit concerned that my attorney wants to send the response to my RFE to the courier address for TSC rather than the po box listed on the gold sheet. Is this ok? Will the response reach the right place? They always use FedEx so they are saying that this is how they will send it.
People who had an EVL RFE on their 485 from TSC please respond.

I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!
If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.
