As of May 29, 2009, approximately 45,800 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

My wife who is a derivative applicant for the GC is employed on EAD. She has been advised to go on a pregnancy short term disability leave by the doctor. We live in California and her company provides the short term disability through the California SDI.
Is it ok to claim this while having applied for GC. Is the SDI by any chance considered a public charge? Any help would be appreciated.

I was in H1B visa(expires on Feb 2011). I got laid off from Employer_A from March 2009 and I transfered my I-797 to Employer_B in march 2009 itself through premium processing. It got approved and I have original approval notice also which expires on March 2012.
Now Employer_A likes to re-hire me back. I am also interested to go back. Do I need to transfer again from Employer_B to Employer_A?
Can I work for Employer_A with old I-797(expires on Feb 2011) ? I don't think Employer_A canceled or revoked my I-797 after they laid off.

Hi - I am currently on H1B visa with 3 more years to go and visa stamped for next 3 years. I've got offer for Medical residency and they offer J1 only.
I am planning to change my status to J1 effective July 01 2009. Do I need to go India for visa stamping or any other procedure? Is just change of status okay?
Please help if you know anything related to this procedure.

AFAIK if company A did not revoked H1B I guess you can join Company A, please also check with any attorney.

Sending Personal checks do not matter. Most attornies collect the application fee from us and send their checks to USCIS. I sent my personal checks to DHS.

My I-140 & I-485 were filed concurrently in July and I have received the receipt notices last week. I have been told by my manager that I have been considered for a promotion. The job title changes from Sr.Database Administrator to Sr.Database Administrator,Staff. The new job after promotion will have additional/new responsibilities like leading/mentoring the team members in addition to the current job responsibilities. I have the following questions:
(1) Is there any risk to GC processing if the job title changes ?
(2) Is there anything that needs to be done/filed with USCIS to reflect the job title change ?

Hi, Cled. You got a good shadow in there, but it's opposing the direction of sunlight (note the flower's stamen which has a shadow coming towards the camera).
The person appears to have been caught in "mid leap" although intended to be kneeling. I'm not sure how you'd really do something about that. Perhaps by making the shadow appear darker and less blurred near knees and shoes?
As far as blending the person over the flower, looks good - no funny edges or outlines.
