Can you please help me figure out how to calculate the eligibility for citizenship. If one married a US citizen. Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?

I at times see that something was updated on my case..."last updated date" but then there is no status update.....for example this happened on my I131 application on Feb 4, 2009
On the I485 I think it is just that they transferred it from one office to another as the status says.

I understand that in october, they might bring up some issues regarding Legal Green Card application.
One of them will be to clear the backlog for those who legally applied for the GC.
Can some kind soul please give me information about this ?
Does this applies to me or does it applies to the Employment based GC or GC application in general ?

I am in desperate need of answer to my question and good thing I found this forum.
I have a boyfriend who was a refugee and so he has a special case green card that doesn't expire. He was 2 yrs. old when he came here but never thought about applying for citizenship. Last year, we decided to go to Philippines this Feb 2011 due to a friend's wedding and vacation. He couldn't apply for passport since he was born in a refugee camp and so he doesn't have a birth certificate. He decided to apply for a I 131 on August. According to the I 797 that he received, received date was Aug. 30, 2010, notice date was Sept. 1, 2010. Since we were expecting to receive the I 131 before our travel date (feb 4th to be exact), we decided to buy the tickets last month (december). He's been calling USCIS about his status and yet, he got the same response as to what is posted when he checks his status online "accepted" which is not very helpful. He asked the customer service rep if he can expedite it and they said, they can't do anything about it. It's very frustrating that we can't get hold of anyone who's really working on his paper. Then somebody told us to try Infopass. He scheduled it today but the earliest date is on Jan. 21st which is like 2 weeks after our scheduled departure. Will that be enough time for them to process it just in case they will just gonna process it by then?
My other questions are, can Infopass help him with his problem? Can they release his I 131 or refugee travel document by the time of his appointment? According to their processing time, it should take them 3 months and it's been more than 3 months, can we travel without a travel document and without a passport? This is very frustrating and stressful... Your response is very much appreciated..

Hi,
I was on an F1 visa until Oct, 2008 and on H1-b visa after that.
The expiry date on my F1 visa stamp is in 2011.
I intend to convert from H1 to F1 . Do I require a new F1 visa stamp or will my old stamping be valid still?

I am in the same situation. I have already sent my FOIA request about 3 weeks back. They have processed only 250 request in last one week. They have around 8600 requests. So it will take around 7 to 9 months to get the docs.
Since you will be asking only for I-140 and/or perm docs, there will be no cost.
You need to know SOC code/Job responsibilities/Salary for using AC-21.
Hopefully, some one who has more knowledge will reply to your other questions.

Hi, guys,
I'm having a little trouble with counting the years of experience for my EB2 petition. My attorney said I can only count the number of years I worked before joining the current sponsoring company!! The situation is, I jointed this company in Jan 2004. But my petition (Labor) appliction only started at the end of 2006. My attorney says that the three years of working experience (04, 05 & 06) can not be counted!
Is he correct on this?

Here is something we really should watch closely. US senate race in Massachusetts between Democrat Coakley and Republican Brown. They are fighting for the vacant seat of Hon. Late Senator Ted Kennedy. Now, people would think, why a race in mass. matter? It's a completely blue state, and had no republican senator in last 40 yrs, obviously a democrat would win. The election is on tuesday and the ground reality seems to suggest something else.
This seat is crucial for President and Democrats as it is the much coveted 60th seat in the senate to get a filabuster-proof majority which democrats have enjoyed so far. It is critical for healthcare reform as well as for immigration reform (if at all it comes).
The gap between both the candidates was narrow with democrat leading but today, for the first time, polls indicate that Brown has taken lead over Coakley. People in this blue state seem to increasingly support Brown, mainly frustrated because of healthcare policies. Mass residents already have a healthcare related tax to help run state's universal health care. On top of that, federal health overall would be adding more taxes on people and people fear that they will end paying both. Already, mass is a very high tax state. So, there is an increasing popularity to tax-related fiscal conservative campaign run by Brown.
This is surely gonna be a nail-biter; so let's wait and watch this one. Election is coming tuesday.

You can certainly file for EB-1 or EB-2 based on the job discription. You will need to file new LC/ I-140 in the respective category and once approved you can port your earlier PD.
