F1 to H1..
My H1 is still pending..RFE on Oct 1st and employer replied..but staus is still same saying RFE sent..case on hold..
can I go for OPT Extension now as my current OPT dint end yet??
Do I need to work in this current OPT to be qualified for OPT Extension or is it sufficient if I have an offer from my employer and he is E-verified??
Looks like some of you got approval for OPT extension..so please help me by posting how you applied..
Let me know of legal stay during these times..

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.

I think once the I-140 application is filed based on the state of residence, USCIS can transfer it to any service center. The applicant doesnt have any control over it. As far as I know, the applicant cannot request for a change in service center.

The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. Due to my father's illness, I decided to skip this year's show. But I'm avidly watching online for announcements of the year's best new innovations. I have to file for I-485 along with EAD and AP, I live in Phoenix and I am applying for 485 based on an approved I-140 based on NIW. Please let me know if I have to file in the Phoenix lockbox or send it to Nebraska.

My wife is going for h1b stamping in Chennai on Jan 17th. She converted from H4 to H1 and and is doing her first year residency in a community hospital in New York. We have all required documentation. Letter from Hosp, 797, 129, LCA, offer letter, ECFMG certification, USMLE transcripts, degree, school transcripts.
In addition, I am asking her to take utility bills and bank certificates and paystubs.
As she was in h4 for 2 years, would the VO be asking her for my stuff like, my w2s, my paystubs etc????
Has anyone gone through this? Any specific questions related to residency? Does she need to take information about the hospital like brochures, etc.... does a visa interview for a Physician focus on the hospital and its operations????

Hi, I have approved H1b through company "NewCompany" but my GC sponsoring company "GCcompany" is planning to cancel my APPROVED 140. Again, I know USCIS will do inted to deny and Yes, I have filed for 485 + it's been 180+ days but I guess the most important question of all is:-
"Will this affect my H1B status?' Since the approval for new 3 year (extension) was based on my 140 and now this thing is under jeopardy. If I use EAD, my wife will no longer be H4 and thats a different problem- Gosh when is thind going to end?"

Is there any body who have I485 filed at TSC and EAD and AP filed at NSC. If it is so, will that create problem in getting that EAD card? Since, they check 485 filing for EAD card production. Please advice.

Hi,
My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

Hi,
My attorney missed the RFE deadline for my H1B extension as the RFE was never received even though USCIS sent it. Please let me know your experience if any one missed responding to RFE deadline for H1B extension and what procedures they followed to fix the issue. Please advise.
